1. Seller's Identity
These General Terms and Conditions of Sale, hereinafter referred to as the "GTC," are offered by:
AMPLIFEO SARL, limited liability company with a share capital of 3,000 euros, registered with the Strasbourg Trade and Companies Register under the number 921,501,771, whose registered office is located at 32 Robertsau Alley, 67000 Strasbourg, France.
Intra-community VAT number: The text "FR87921501771" appears to be a code or identifier rather than a phrase or sentence in French. It does not require translation and remains the same in English: FR87921501771.

AMPLIFEO SARL is hereinafter referred to as "Fabrikeo" or the "Seller".
2. Purpose and Scope
These General Terms and Conditions of Sale govern all sales made by Fabrikeo on its website, by quotation, by email, or by any other means of distance selling.
Fabrikeo sells, among other things, signs, cut letters and logos, panels, plaques, signage, illuminated signs, printed supports, and decorative elements, whether personalized or not.
The General Terms and Conditions of Sale (GTCS) apply to both consumers and professionals. The provisions reserved for consumers apply only to natural persons acting outside of their professional activity.
Any order implies full and unconditional acceptance of these General Terms and Conditions of Sale.
3. Products and customization
The majority of the Products sold by Fabrikeo are specially manufactured according to the dimensions, files, texts, logos, colors, materials, finishes, thicknesses, or fastening systems chosen by the Client.
The photographs, illustrations, simulations, and scenarios presented on the site or provided to the Client are for illustrative purposes only. The dimensions and written specifications appearing on the quote, order, or proof sheet take precedence over the visual impression produced by a mock-up.
Colors may vary depending on the screens, materials, printing or painting processes, and lighting conditions. Natural materials, especially wood, may exhibit differences in shade, grain, or texture that do not constitute a defect.
Slight tolerances in dimensions, cutting, thickness, color, positioning, or finishing may result from manufacturing processes. These do not constitute non-compliance as long as they do not affect the use or the expected general appearance of the Product.
4. Information and files provided by the Client
The Client is responsible for the accuracy of the dimensions, texts, translations, colors, graphic files, contact details, and other information they provide to Fabrikeo.
It is specifically their responsibility to check the dimensions of the installation area, the compatibility of the Product with its support, the spelling of the texts, the quality of the files, and whether the Product is intended for indoor or outdoor use.
Fabrikeo cannot be held responsible for an error resulting directly from incorrect, incomplete, or inaccurate information provided or validated by the Client.
The Client guarantees that they have the necessary rights to the logos, trademarks, images, texts, fonts, and files provided. They indemnify Fabrikeo against any third-party claims related to their use for the completion of the order.
When the transmitted files are not directly usable, Fabrikeo can offer an additional service of vectorization, correction, or adaptation.
5. Quote, order, and payment
Quotes are valid for the period indicated on them or, failing that, for thirty days from their date of issue.
The order becomes firm after the acceptance of the quote or the validation of the order online, the acceptance of these General Terms and Conditions of Sale, and the receipt of the requested payment.
Unless otherwise agreed in writing, payment is due in full upon ordering. No order for materials, manufacturing, cutting, printing, or shipping will be initiated before payment is received.
The payment methods offered may include credit card, PayPal, and bank transfer.
Prices are expressed in euros, excluding taxes and including all taxes where applicable. Delivery fees, special packaging, design, vectorization, customs, or other additional charges are billed when indicated on the website, the quote, or the order.
For professional clients, any late payment will result in the application of penalties at the applicable legal rate as well as a fixed compensation of 40 euros for recovery costs.
Fabrikeo retains ownership of the Products until full payment of the order.
6. Proofreading approval
When a print proof, a mock-up, a dimension plan, or a preview is provided, the Client must carefully check the texts, spelling, dimensions, proportions, colors, quantities, materials, finishes, drillings, and the overall appearance before approval.
Validation can be carried out by signature, from the Client area, by email, or by any wording such as "validated," "approved," or "you may proceed with manufacturing."
After approval, the final proof becomes the contractual reference used for production.
An error or characteristic clearly appearing on the approved proof will not be considered an error by Fabrikeo, unless the delivered product does not match the approved proof or presents a defect covered by a legal warranty.
Any modification requested after approval may be refused or may require an additional quote and a new deadline.
7. Order Cancellation
Given the customized nature of the Products, an order can no longer be freely canceled once the design has started, the materials have been ordered, the proof has been approved, or the manufacturing has begun.
When a cancellation is exceptionally accepted, Fabrikeo may retain or charge amounts corresponding to the studies carried out, the files prepared, the materials ordered, the products already manufactured, and other expenses incurred.
For professional clients, any accepted order is firm and final, unless otherwise agreed in writing by Fabrikeo.
8. Manufacturing and deadlines
The production times begin only after receipt of payment, usable files, the necessary information, and approval of the proof when required.
Any delay by the Client in sending or approving an item automatically postpones the start of the deadline.
The deadlines are expressed in business days. They do not include Saturdays, Sundays, public holidays, announced closure periods, transportation times, or customs formalities.
The indicated deadlines are estimates, except when a firm date has been expressly accepted in writing by Fabrikeo.
In the absence of an agreed deadline, the Product ordered by a consumer Client is delivered without undue delay and at the latest within the legal period following the conclusion of the contract, provided that the Client has supplied all the necessary information.
In case of delay, the consumer Client has the rights provided by the Consumer Code, notably the right to formally notify Fabrikeo to deliver within an additional reasonable period before requesting, when the legal conditions are met, the cancellation of the order.
9. Delivery
The delivery is made to the address provided by the Customer. The Customer must verify its accuracy, accessibility, and the presence of a person able to receive the goods.
Fees resulting from an incorrect address, absence, uncollected package, failed delivery, return, or redelivery may be charged to the Client.
For the Consumer Client, the risk of loss or damage is transferred upon the physical possession of the Product by the Client or by a third party designated by them.
When the Consumer Client chooses a carrier that has not been proposed by Fabrikeo, the risk is transferred upon handing over the Product to that carrier.
For the Professional Client, unless otherwise agreed in writing, the risks are transferred upon delivery of the Product to the carrier or upon its collection.
10. Product damaged during transport
Upon delivery, the Customer must check the condition of the package and, if possible, its contents in the presence of the carrier.
In case of visible damage, the Customer must write precise reservations describing the observed damage on the delivery document. A general note such as "subject to unpacking" may be insufficient.
The Customer must inform Fabrikeo as soon as possible, ideally within forty-eight hours of receipt, by providing their order number, a description of the damage, photographs of the outer package, the inside of the package, the protective materials, the damaged Product, and the shipping label.
The Customer must keep the Product and all its packaging until the claim is resolved. They must not discard, repair, modify, or install the Product before receiving approval from Fabrikeo.
This procedure facilitates recourse with the carrier but does not deprive the consumer client of their legal guarantees.
11. Claims and Non-conformity
Any complaint must be addressed to contact@fabrikeo.com with the order number, a detailed description of the problem, and photographs to allow for examination.
Fabrikeo may request photographs, videos, measurements, or additional information and, when necessary, the return of the Product.
The Client must allow Fabrikeo to examine the defect and propose a solution before having the Product repaired, modified, or replaced by a third party.
The following do not constitute a non-compliance in particular: a change of mind, a subjective assessment of the output, an error appearing on the approved proof, a dimension provided by the Client, a reasonable technical variation, a natural variation of the material, improper installation, improper use, a modification of the Product, an impact, or normal wear and tear.
12. No right of withdrawal for personalized Products
In accordance with Article L.221-28, 3° of the Consumer Code, the right of withdrawal cannot be exercised for goods made according to the consumer's specifications or clearly personalized.
As a result, no withdrawal, return, cancellation, exchange request, or refund request can be accepted when the Product has been manufactured in accordance with the order and the approved proof.
The fact that the Product ultimately does not please the Customer, that they have changed their mind, that they have misjudged the dimensions, or that they can no longer install the Product does not constitute a reason for return or refund.
This exclusion does not deprive the Customer of their rights when the Product is defective or does not correspond to the confirmed order.
13. Withdrawal of Non-personalized Products
For non-customized products legally entitled to a right of withdrawal, the consumer Client has a period of fourteen days from the date of receipt to inform Fabrikeo of their decision.
The request must be addressed to contact@fabrikeo.com. The instructions and the return address will then be communicated to the Client.
The Product must be returned complete, properly protected, and in a condition suitable for resale. Direct return costs are the responsibility of the Customer, unless otherwise provided by law.
The refund is made under the conditions and within the time limits provided by law. Fabrikeo may delay the refund until the Product is recovered or until proof of its shipment is received.
14. Legal Warranties
The consumer client benefits from the legal guarantee of conformity provided for by articles L.217-1 and following of the Consumer Code and from the guarantee against hidden defects provided for by articles 1641 and following of the Civil Code.
Box related to the legal guarantee of conformity
The consumer has a period of two years from the delivery of the product to invoke the legal guarantee of conformity in case a conformity defect appears. During this period, the consumer is only required to prove the existence of the conformity defect and not the date on which it appeared.
The legal guarantee of conformity gives the consumer the right to repair or replace the product within thirty days following their request, free of charge and without major inconvenience to them.
If the item is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests the repair of the item but the Seller imposes its replacement, the legal warranty of conformity is renewed for a period of two years from the date of the replacement.
The consumer may obtain a price reduction by keeping the item or terminate the contract by returning the item when the Seller refuses repair or replacement, when the compliance occurs after thirty days, when it causes a major inconvenience, or when the non-compliance persists despite an attempt to bring it into conformity.
The consumer can also immediately obtain a price reduction or contract termination when the defect is sufficiently serious. However, termination cannot be requested when the defect is minor.
Any period during which the item is immobilized for repair or replacement suspends the remaining warranty until the restored item is delivered.
The consumer also benefits from the warranty against hidden defects provided for in Articles 1641 to 1649 of the Civil Code for two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the item is kept or to a refund upon the return of the item.
15. Installation and installation partners
Fabrikeo does not carry out the installation or fitting of the Products. Unless otherwise stated in writing in a separate contract, the order does not include installation, removal, drilling, electrical connection, or rental of a cherry picker or scaffolding.
The Client is responsible for choosing their installer, verifying their support, ensuring the compatibility of the fastenings, and obtaining any necessary administrative authorizations from the owner, landlord, or co-ownership.
At the Client's request, Fabrikeo may provide the contact details of one or more independent installers. This communication solely constitutes a connection.
The installation contract is concluded directly between the Client and the installer. The installer prepares their own quote, sets their prices, invoices the Client directly, and remains solely responsible for their work.
Fabrikeo does not guarantee the availability, rates, deadlines, or services of the recommended partner and cannot be held responsible for their actions, except in the case of personal fault directly attributable to Fabrikeo.
16. Liability and Force Majeure
Fabrikeo is responsible for the proper performance of its obligations under the conditions provided by law.
Its liability cannot be incurred when the damage results from incorrect information provided by the Client, improper installation, non-compliant use, lack of maintenance, modification of the Product, intervention by a third party, or a force majeure event.
For professional clients, Fabrikeo cannot be held liable for indirect losses, including loss of revenue, operating income, clientele, reputation, or opportunities.
Except in cases of gross negligence, intentional fault, bodily injury, or contrary mandatory legal rule, Fabrikeo's liability towards a professional Client is limited to the pre-tax amount of the order concerned.
No limitation in these General Terms and Conditions of Sale reduces the mandatory rights of consumer Customers.
17. Personal data
The Client's personal data is collected for the management of requests, quotes, orders, payments, manufacturing, deliveries, complaints, and accounting obligations.
They may be transmitted to the service providers necessary for the execution of the order, including manufacturers, carriers, and payment service providers.
The Client has the rights of access, rectification, deletion, limitation, objection, and portability as provided by the regulations. Any request can be sent to contact@fabrikeo.com.
The Client may also file a complaint with the CNIL.
18. Intellectual Property
The content of the Fabrikeo website, including texts, photographs, illustrations, models, mock-ups, and graphic elements, is protected by intellectual property rights.
Any unauthorized reproduction or use is prohibited.
The manufacturing files, source files, technical drawings, methods, and preparatory documents created by Fabrikeo remain its property, unless expressly transferred in writing.
19. Mediation and disputes
For any complaint, the Client must first contact Fabrikeo at the address contact@fabrikeo.com in order to seek an amicable solution.
In the event of a failure of the prior complaint, the consumer Client may contact the consumer mediator to whom AMPLIFEO SARL has adhered, free of charge:

These General Terms and Conditions of Sale are governed by French law.
For consumer clients, the competent courts are determined in accordance with the applicable legal rules.
For professional clients with the status of merchant, any dispute not resolved amicably will be submitted to the competent courts of Strasbourg, subject to applicable mandatory rules.
When these General Terms and Conditions of Sale (GTC) are translated into another language, the French version shall prevail in case of any interpretation difficulties, without depriving the consumer of the mandatory protections applicable in their country of residence.
20. Withdrawal form
This form applies only to non-customized products eligible for the right of withdrawal.
